Important notice for Unifor 2002 members at ASP

On February 11, 2022, Unifor was notified by ASP Security that they had lost the contract for the Canine Division and Operational Support Representatives (OSR) effective May 1, 2022. This decision affects almost 200 Unifor members.

  

DISCUSSIONS WITH ASP SECURITY

Unifor has had several discussions with ASP and is waiting for the employer’s final position in regards to severance pay as per the Canada labour Code.

ASP’s initial position is that the employees will be laid off and will have recall rights as per the Collective Bargaining Agreement. However, Unifor is taking the position that since ASP has lost the contract, there is no position for our members to be recalled back to. Therefore, we are asking that ASP pays severance as per the Canada Labour Code:

An employee is entitled to the equivalent of two days pay at the employee’s regular rate of wages for regular hours of work for each complete year of employment, with a minimum benefit equivalent to five days wages.

  

DISCUSSION AND LOBBYING WITH GTAA

Unifor would hope that the Greater Toronto Airports Authority (GTAA) would want to safeguard this important line of work, and has the capacity to ensure that Unifor workers who have served at Pearson Airport for many years are treated with respect.

Unifor has also reached out to GTAA to discuss what actions can be taken to mitigate the adverse affect of this decision to our members.

Unifor has been informed by the GTAA that their team is familiar with the transition from ASP Security to Dexterra Group and confirmed that the majority of the affected workers have received the necessary information regarding their transfer (i.e. they are being offered positions and comparable remuneration for their work).

At this time, we are still waiting for ASP’s final position in regards to the severance pay as per the Canada Labour Code.
