Canadian North Members: Bargaining Update for October 6, 2020

Following a series of ratification meetings which were held virtually in August, the membership at Canadian North rejected their tentative agreement that was recommended by their Bargaining Committee. Since then, the union and the company have jointly filed for conciliation on October 1st, 2020. We will meet with the Company and the Conciliator once the dates are mutually agreed upon.  

What is the Conciliation Process?
 
  • Unifor/Company filed a Notice of Dispute to the Federal Minister of Labour
  • Minister will appoint a Federal Conciliation Officer within 15 days
  • The Conciliator will meet with Union and Employer over a 60-day period to facilitate negotiations
  • The parties may agree to extend the conciliation period if negotiations are progressing
  • At the end of this period, the parties enter a 21 day "cooling off period”
  • Conciliator files report to the Federal Minister of Labour
  • While in conciliation, the Company may not lock out employees and the Union may not take strike action. Strike action is only ever taken as a last resort and after conditions (such as a strike vote and 72 hours advance notice) are met
 
TimeBank
The union filed a policy grievance on the payout of the timebank on September 15th, 2020 and we requested a cease and desist until we were able to come to a solution on this matter. The Unifor lawyers spoke with the company lawyers on this matter and the company did what they thought they needed to do following the changes to the Canada Labour Code last September 2019. 

Members affected by the payout were offered options of transferring their bank time into their RRSP. The Company is willing to work with the Union to fix this matter going forward.

Vacation Bidding Delayed 
We have jointly agreed to delay the bid until November 15th 2020, to develop a proper process encompassing all members currently working and those on lay off as many will not have paid vacation in 2021. We will keep you updated with conciliation dates and any further Timebank updates as soon as they are available.
