Unifor Files for Conciliation with Swissport Vancouver

Your Unifor bargaining committee met with the Employer virtually on March 2, 2022 to open negotiations. Further meetings took place on March 8-10, April 12-14 and May 17-19th 2022. By the end of all of these sessions, the Union – in good faith – had provided the Employer with all of our proposals, and we had worked diligently on a key Article pertaining to scheduling. It was agreed-to by the parties that a response would be provided by the Employer; one expected to be reasonable and constructive towards furthering our process to a mutually and equally prosperous conclusion. Throughout our last week together, the Union felt that the Employer had no real intentions of bargaining a reasonable agreement, that was evident in their last pass back to the union.

Unfortunately, despite having had one full month to prepare their responses, Swissport was not prepared to respond to our full monetary package of proposals, nor was the Employer prepared to meet with the Union to continue with the negotiation process until July.

As a result, Unifor has filed a notice of dispute to the Federal Minister of Labour on May 27, 2002. Under this process, the Minister will appoint a Federal Conciliation Officer within 15 days of receipt of the notice. Once a Conciliator has been appointed, the conciliation process will begin.

  

WHAT IS CONCILIATION?

  1. Unifor files a Notice of Dispute to the Federal Minister of Labour
  2. Minister will appoint a Federal Conciliation Officer within 15 days
  3. The Conciliator will meet with the Union and Employer over a 60-day period to facilitate negotiations
  4. The parties may agree to extend the conciliation period if negotiations are progressing
  5. Conciliator files report to the Federal Minister of Labour once conciliation period is complete
  6. The parties enter a 21 day “cooling off” and mediation period
  7. At the end of the 21 days if no agreement has been reached the Mediator will file an additional report with the Minister of labour
  8. While in the conciliation and the “cooling off” mediation period, the Company may not lock out employees and the Union may not take strike action. Strike action is only ever taken as a very last resort and only after conditions (such as a strike vote and 72 hours advance notice) are met.
