ASP Security: CIRB releases decision on Maintenance of Activities Agreement

The Canada Industrial Relations Board (CIRB) has rendered a decision concerning the employer’s application to obtain a Maintenance of Activities Agreement. This decision would determine if activities or services must be maintained in the event of a strike or lockout in accordance with section 87.4(1) of the Canada Labour Code.

In a written response received by Unifor’s legal department, the CIRB has dismissed ASP’s application, in part due to the following issues raised by Unifor:

  1. ASP did not, within 15 days of the union’s notice to bargain in October 2022, raise an issue about the Maintenance of Activities Agreement, pursuant to section 87.4(2) of the Code.

  2. Unifor argued that ASP did not, within 15 days of the union’s filing of a notice of dispute on September 7, 2023, file an application under section 87.4(4) of the Code.
      

Unifor is pleased with the CIRB decision and would like to inform the Unifor membership that both parties (the union and the employer) are committed that no job action will be permitted without first meeting with a conciliator. The parties are still scheduled to convene in-person on January 19th, 2024 in Toronto.

We will provide a further update once this meeting concludes.

The current collective bargaining agreement between Unifor and ASP Security expired on December 31, 2022, but remains in effect.
