As a follow up to our October 16th communication, we can report that your Unifor Bargaining Committee has received a final contract offer from ASP Security (the employer).

On October 23rd, the Unifor Bargaining Committee met virtually to review details of this final offer and determine the next steps. After much deliberation of what was put forth as a final offer by ASP, and taking into consideration the strong mandate provided to the Committee from the membership, it was determined that this final offer was not acceptable, nor fair.

However, in an effort to remain open and transparent, your elected Bargaining Committee has chosen to present this final offer to you. Why? Collective bargaining is an essential tool when building workers’ power. It is also the decision of the membership whether to accept or reject a new contract.

A series of in-person meetings and voting will take place as follows:

Please take the time to attend one or more of these meetings. During meetings, your Unifor Bargaining Committee will be presenting details of the employer’s final contract offer, and answering any questions you may have.

  

LET US BE CLEAR

What your employer has put forward as a new and final contract offer is NOT in line with what you have mandated your Bargaining Committee to negotiate. Accordingly, your Unifor Bargaining Committee is NOT recommending acceptance of this final offer. Please take the time to attend a meeting and have your say by voting on the employer’s final offer.

  

REJECTING THE FINAL OFFER

If you do not agree with the terms offered by your employer as presented in the final offer (i.e. casting a ‘no’ vote), you will be providing your Unifor Bargaining Committee with authorization to withhold your labour in the form of strike action if and when required.

Strike authorization votes must take place before Unifor can lawfully commence strike action. In addition to meeting this legal requirement, strike votes are an opportunity for Unifor members to show support and solidarity for their Bargaining Committee, in their continued efforts to reach a fairly negotiated agreement.

NOTE: Strike action is only ever taken as a last resort, and only after all conditions and discussions are exhausted between the negotiating parties.

  

TIMELINE AND SOLIDARITY

As stated in our previous communication, the conciliation timeline is winding down and will conclude on November 11, 2023. If a new contract has not been reached by November 11th, a 21-day cooling off period will begin. If at the end of the 21 days, an agreement has still not been reached, the Mediator will file an additional report with the Minister of Labour.

While in the conciliation and the “cooling off” period, ASP Security may not lock out employees, and Unifor may not take strike action.

Your unity and solidarity will be a key factor in Unifor obtaining a deal for you.
