GTAA: Compensatory and Lieu Time

The current Unifor-GTAA collective agreement contains articles pertaining to compensatory and lieu time being used within the contract year, August 1st 2013 to July 31st 2014. The agreement states that unused lieu time – as of July 31st 2014 – would be paid out at the July 31st rate of pay.

Following the ratification and implementation of the current collective agreement, there were different interpretations by the employer and the union with respect to an employee’s ability to schedule compensatory or lieu time beyond July 31st 2014.

In an effort to avoid the grievance process and the subsequent arbitration process, the GTAA and Unifor Local 2002 have agreed to apply the following specifics to articles 17:02 (b) (i) and 18.06:

  1. For 2014, members will be permitted to book compensatory or lieu time earned in 2014 beyond July 31st, and for the period August 1, 2014 through December 31, 2014. If this time is approved by the Employer before July 20, 2014, the approved hours will be marked on the schedule and will not be cashed out on July 31st. All other compensatory and lieu time which is not approved as time to be taken between August 1, 2014 and December 31, 2014 will be cashed out as per the language in the collective agreement. This is beneficial to our members as there are great amounts of overtime worked due to the quantity of adverse weather Pearson has experienced this winter thereby giving members an option for more time off through the summer months of 2014.

  2. For 2015, members will not be afforded the same opportunity as described in the above point. All compensatory and lieu time as of July 31st will be cashed out. Therefore, members should use compensatory and lieu time prior to August 1, 2015 and other leave beyond this date (i.e. vacation).

  3. For 2016, the parties will be in collective bargaining for a renewal agreement in which this interpretation will be clarified by the employer and bargaining committee. We have requested that an automatic payout not occur for this year in case the collective bargaining agreement is not ratified prior to August 1, 2016.
