BARGAINING UPDATE

On June 16 and 17 the Bargaining Committee met with Management and is scheduled to continue Bargaining on June 23 and 24. These will be the last scheduled meetings with the Company before the end of the current Collective Agreement which expires at midnight June 30, 2009. Even though the Collective Agreement will have expired it will remain in effect until the end of the Conciliation/Mediation period in accordance with the Canada Labor Code.

The formal appointment of the Conciliator has been completed and although the Officer was not present at the last meeting, the time lines for the expiration of the process have commenced. Pursuant to section 73.2 (b) of the Canada Labour Code, the Officer’s mandate is subject to extension by the Minister up to 60 days from the date of appointment. Any extension beyond the 60 days (August 8, 2009) can be made only by the consent of both parties.

The overwhelming support for the current Bargaining Committee and Bargaining Process as a result of the CAW Resolution (see attached) allows the Bargaining Committee to reiterate that there were no intentions to compromise the mandated proposals of the Membership. Membership solidarity is essential to the process of reaching our mandate. Also the latest developments at Air Canada are being viewed as an opportunity to move forward in Bargaining independently with Jazz.
