In response to the bulletin regarding Time Bank Balances and Vacation Top Up – posted by Management on December 17, 2009 – the Union contends that since the implementation of the new Collective Agreement, Management has been manipulating and ultimately violating the agreement.

Issues have ranged from implementation of shift schedules, in particular bases without consultation and agreement by Union Officers and Local Management. The Union does not agree with the way Management has calculated and implemented vacation slots. Management has been deferring grievances to full arbitration; this practice prolongs the process and further frustrates the Union and the Membership.

Management has informed the Union and the Membership that any final vacation slot that has been bid and approved will be revoked from Members that cannot pay for any shortfall by the end of this year. This clearly violates the agreement as it is clear that once vacation has been approved it cannot be changed unless it is mutually agreed to between the employee and employer.

Furthermore the final vacation week that used to be allowed to be bid without sufficient time/funds to cover that week at the time of bidding will no longer be allowed. This clearly violates the agreement whereby it states that the hours will be deducted when the time is taken, also past practice has seen this time allowed to be taken without pay should he employee decide to do so.

Just a reminder that this time of year brings with it added pressure and stresses above and beyond the aforementioned, and there is added concern that oversights and mistakes could occur. It is imperative that all Members realize their important role in maintaining a safe operation.
