CAW begins process to litigate outsourcing of post paint flight control balancing

During the last several weeks Jazz management has requested that your CAW Bargaining Committee allow post paint flight control balancing and other related work to be performed by the external company that paints our aircraft. Also, part of Jazz management’s request was to allow this outsourcing of our work to become permanent. The CAW has denied both of Jazz management’s requests.

The Union and Jazz Management agreed this matter will be heard by an arbitrator. The date of January 25th 2008 has been set aside to have Arbitrator Teplitsky hear the case through a Mediation process. Mediation allows the Union and Company to work towards an agreement with the assistance of a third party. If a voluntary agreement is not reached the Mediator does not issue a binding order and the matter will proceed to arbitration. The CAW and Jazz management will then select a suitable Arbitrator to hear the matter and make an order that is binding upon both parties.

In response to Jazz management the CAW Bargaining Committee said the work in dispute was certainly not unscheduled nor beyond the capability of CAW members to perform. Moreover, the Company had ample time to draft personnel from anywhere in the system who could complete these tasks.

As an act of good faith the CAW asked Jazz management to continue the past practice of using Jazz Tech members to perform this work until such time as the issue is resolved. Jazz management has chosen to ignore your Unions request and will continue to outsource the work. It is becoming clear that Jazz management is not demonstrating the loyalty and goodwill towards employees they ask for in return. This current issue of outsourcing will now proceed to mediation on January 25 with Arbitrator Teplitsky attempting to facilitate a voluntary settlement.
