EMPLOYEE UPDATE

The Vacation Bidding process for 2010 is currently underway in most bases. It has come to the Union’s attention that the Company is not following the language as it pertains to the calculation of vacation slots nor is the Company properly applying the calculated slots to the scheduled shifts.

After trying to resolve the situation through informal correspondence, the Union and Company remain opposed in their respective positions regarding the issue. However, Management has informed the Union that the Vacation Bid process will go ahead as per their interpretation of the language.

The Union has filed a Policy Grievance with regards to the issue. In accordance with the Grievance Procedure there is an initial ten (10) day period in which the Step 2 Grievance hearing must occur from date of filing which was October 30, 2009. After the hearing date the Company has fifteen (15) days to respond to the Union as to their position. Failing a resolve to the issue at this point the Union can advance the Grievance to the Arbitration Process.

Given the time lines and the fact it is unlikely this issue will be resolved before the bidding process has concluded, the Union recommends that all Employees bid their vacation. This recommendation is made so that Employees do not get into a situation where by the Company assigns Vacation Dates which may be undesirable.
