ASP Security Members: Bargaining Update - Unifor to File for Conciliation

We wanted to provide you with an update on the recent developments regarding our negotiations with the Company.  Over the past few days, your Bargaining Committee has engaged in discussions with the Company on your behalf. We held meetings on August 29th and 31st to address various matters, particularly focusing on monetary issues.

However, as of the conclusion of the meeting on August 31st, we find ourselves significantly far apart from the Company on these crucial matters. Despite our best efforts to bridge the gap, it appears that there is still much work to be done to find common ground. Considering the current situation and the need to ensure the best possible outcome for all union members Unifor National will be filing for conciliation.

WHAT IS CONCILIATION?
Conciliation is a process that involves bringing in a neutral third party to assist both parties in reaching an agreement. This step is being taken to help facilitate more productive negotiations and hopefully lead us toward a resolution that meets the needs and concerns of our members.
 
  1. Unifor files a Notice of Dispute to the Federal Minister of Labour
  2. Minister will appoint a Federal Conciliation Officer within 15 days.
  3. The Conciliator will meet with the Union and Employer over a 60-day period to facilitate negotiations.
  4. The parties may agree to extend the conciliation period if negotiations are progressing.
  5. The conciliator files a report to the Federal Minister of Labour once the conciliation period is complete.
  6. The parties enter a 21-day “cooling off” and mediation period.
  7. At the end of the 21 days if no agreement has been reached the Mediator will file an additional report with the Minister of Labour
  8. While in the conciliation and the “cooling off” mediation period, the Company may not lock out employees and the Union may not take strike action. Strike action is only ever taken as a very last resort and only after conditions (such as a strike vote and 72 hours advance notice) are met.
