Worldwide Flight Services - District 410: Staff Reductions and Severance

The Company has recently been handing out staff reduction letters to members. In accordance with Article 10.05 in the Collective Agreement, you will have three (3) days to decide if you are going to be involuntary placed to AST full time status, AST part time status, or take a layoff. If you do not indicate to the Company what your preference will be within the three (3) day period, you will be by-passed and junior members preferences will be actioned before the senior members. If you do not indicate your preference at all to the Company, you will be placed on layoff status.

The Company will issue you a letter after five (5) days from the receipt of the staff reduction letter to make you aware where you will be placed.

If you are on layoff status, your health and insurance benefits will continue to the month following the layoff. You will be paid your unused 2009 vacation pay, your 2010 vacation pay, and any unused hours in your time bank. The Union will be in discussions with the Company tomorrow for those who are on layoff to receive your vacation pay on separate cheques. You will have recall rights for twenty four (24) months. If an employee refuses to accept recall to a permanent position in the position from which they were laid off from will be considered to have resigned. As well, Part time status employees who refuse to accept recall to a permanent position in the position from which they were laid off from, if the schedule weekly hours of work are five (5) or less hours from the schedule the employee was working prior to the layoff, will be considered to have resigned. If you resign, you will not receive Severance Pay.

Right now, Severance Pay will be paid out after your recall rights have expired. For every year of employment you will be paid two (2) days for every year of service, or five (5) days; whichever is greater. We have attached the Severance Article from the Canada Labour Code.

The Union is currently in discussions with the Company for those employees who want to forgo their recall rights and collect your severance pay before your recall rights will expire. This will be voluntary.
