Clarification sought in Jazz CSA/ACS arbitrated award

On September 9, 2013, the union met with the employer and arbitrator Tom Hodges in Toronto in order to seek clarification on two issues related to the arbitrated award issued on July 17, 2013. (Tom Hodges remains seized on all matters in the award.)

The first matter discussed was retroactivity for the 5th week of vacation. The employer took the position that this issue was effective on the date the award was issued (July 17, 2013). The union took the position that the matter was retroactive to January 13, 2013, the date the collective agreement expired. The arbitrator agreed with the union’s interpretation.

The parties signed a Letter of Understanding (LOU) on the retroactivity for the 5th week of vacation. The LOU allows for three different options for our members.

The second issue that needed clarification pertained to the scheduling of the three hour shifts. The parties were not able to come to an agreement on this matter so the arbitrator will issue a separate award in the near future.

The union and the company will meet again on September 25-26, 2013 in Toronto to discuss further issues in the award.
