Jazz CSA / ACS: Arbitration Award for Holiday Payment

The Union filed three grievances on the application of Article 13 of the Collective Agreement, which deals with General Holidays.  The grievances dealt with two aspects of the General Holiday remuneration for members who regularly work shifts in excess of eight hours.  Specifically:
  1. The correct amount of wages / credit hours for an employee working overtime on a holiday and;
  2. Whether or not the eight hour maximum delineated in Article 13.03 applies to employees who normally work a twelve (12) hour shift.
The parties received the arbitrator’s award on September 22, 2010.   Jazz Air was directed to pay its employees, whose regularly scheduled day off falls on a General Holiday the regular hours of wages/credit hours to which they are entitled.  The Employer was directed to correct all future payments regarding General Holidays.

As you know, the Employer has yet to pay those wages/credit hours for the first General Holiday, Thanksgiving.  The Company has advised the Union that they are currently reviewing the process that lead up to the arbitration.  

The parties continue with their discussions and we will advise you of the details as the matter unfolds.
