Jazz CSA/ACS: Update on Newfoundland and Labrador grievances

As a follow up to our October 11th communication, Unifor served notice of its intent to submit multiple grievances to arbitration in response to Jazz's announcement that intendeds to lay off members at selected bases in Atlantic Canada as the Company makes changes to its services.

On November 6, 2023, Arbitrator Tom Hodges was selected and appointed by the parties to hear the Newfoundland and Labrador grievances.

On November 14, 2023 a case management meeting was held with the parties: Tom Hodges (the “Arbitrator”), Unifor, and its Local 2002 (the “Union”), and Jazz Aviation LP (the “Company”).

At the meeting the Company restated its position that the arbitrator should first resolve the issue of jurisdiction given the Company’s preliminary objection. The scheduling and procedures were discussed in an effort to facilitate the resolution of the jurisdiction issue. The parties agreed to disclosure of relevant documents and the underlying facts necessary for analysis. The parties also agreed to exchange submissions regarding the Company’s objection on jurisdiction by December 15, 2023.

Furthermore, a reply submission and final arguments will be heard in late January, 2024 by a video conference hearing.
