Nuance District 335 Unifor Local 2002 Members,
It has come to our attention that the company is conducting meetings without a Union Representative present to properly represent you.
Under your Unifor Collective Agreement, you have the right to have a Union Representative present for all meetings that are, or could lead to, discipline. Do not give up this right that was bargained for your behalf. If the company meets with you and asks whether you want a Union Representative, we strongly recommend that you say yes, even if they say it is “not that important,” “not a big deal,” or “just a conversation.” You always have the right to request Union representation.
In situations the company refers to as “coaching,” a manager or supervisor may inform you that a Union Representative is not required or that one is not available. However, once you ask for a Union Representative, the meeting must be rescheduled until one is available when discipline is a possibility.
You may feel pressured not to ask for a Representative or be led to believe that the company may show leniency if you agree to meet without one. This is not true. Choosing to have Union representation will not be held against you. When in doubt, be firm and clearly state that you are exercising your right to be a Union Representative to protect your interests.
If you choose not to exercise your right to be a Union Representative and sign a waiver instead, it becomes significantly more difficult for the Union to represent you or to file a grievance on your behalf.
Think about it: Always ask for a Union Representative and never waive your rights. When in doubt—always request representation.
