Paladin District 266: Arbitration update

In our April 22nd communication to the membership, Unifor advised that the union and employer had been scheduled for arbitration the last week of May to argue the 11 outstanding workplace grievances. These grievances range from issues such as access to water/water bottles to scope violations.

The Arbitration process can be a lengthy course; however, it is a widely utilized dispute resolution process to render a decision by a neutral party.

During an arbitration, both parties (i.e. union and employer) present their arguments and evidence, including witness testimony. After hearing the case, the arbitrator issues a decision.

Unfortunately, the employer has advised that they are not ready to move ahead with the arbitration as scheduled and has requested a postponement. Unifor denied their request as we believe it is prudent not to delay grievance discussions any further.

Paladin has since requested a hearing with the assigned Arbitrator. After hearing arguments from both the employer and union, the Arbitrator has ordered the adjournment of the arbitration until the week of September 29, 2025.

  

UPDATE ON CALL-IN OVERTIME/“SHIFT SENIOITY” (Article 17 R) Grievance

We are pleased to inform you that we have reached a settlement regarding the grievance related to the use of “Shift Seniority” versus pure seniority for the allocation of call-in overtime.
  
Effective immediately, all call-in overtime opportunities will be awarded based strictly on pure seniority. This decision ensures a fair and consistent approach for all members moving forward.
  
Please note that there will be no retroactive compensation for any members who may have been affected under the previous practice of using shift seniority. However, this resolution represents a positive step in reinforcing seniority rights as outlined in our collective agreement.
  
Important: This settlement pertains specifically to the call-in overtime grievance and should not be confused with the “uplifting” grievance, which remains unresolved and is scheduled to proceed to arbitration in September.
  

  

We will continue to engage in settlement discussions on those grievances where progress is being made.

Unifor is disappointed by this delay any further updates will be provided to the membership as they become available.
