Swissport (former Handlex): Arbitrator Releases Award on the Blue Pass Policy

On July 22, 2018, Arbitrator Claude Martin released the binding award regarding the Blue Pass flight benefits for the former Handlex employees, now employed at Swissport Canada Inc in Montreal, Toronto, and Vancouver.

After hearing both the Union and the Company’s position on the intent of Article 20.08 in the Handlex Customer Service collective agreement, Arbitrator Claude Martin made his award and issued the orders to all parties.

Highlights from the Arbitrator’s Award:
Compensation
The Arbitrator has ordered Swissport to pay the monetary compensation, along with the statutory interest which is to be distributed amongst the employees represented by the Bargaining Units in question, Unifor Local 2002 and Teamsters Quebec Locals 1999 and 931.  

Other benefits
The Arbitrator does not award any sum for the loss of other benefits (discounted hotel, packages, reservation of seats, etc.) due to insufficient evidence of their past use by employees.

Determination of Eligible Persons and Parameters for Sharing
Swissport has yet to provide the award monies to the unions. Once Swissport provides the monies to the unions, it will be placed in a trust account in the name of the three unions.
