On November 21, 2019, Arbitrator Claude Martin held a conference call with the legal parties of Unifor and Swissport to hear their respective arguments pertaining to the blue pass issue. More specifically, this conference call was to discuss how the award was to be divided amongst the four union groups, and not three as previously communicated.
As announced on October 10, 2019, Unifor does not believe that the Arbitrator has jurisdiction since more than a year has elapsed since the decision was issued in July, 2018. Therefore, Unifor believes that Arbitrator Claude Martin cannot modify his decision to distribute the monies which would disfavor Unifor.
A hearing will take place with Arbitrator Claude Martin in Montreal on February 6, 2020 in regards to the jurisdiction issue. In the meantime, the monies have been held in a trust fund account by the Employer. Please note that Unifor, nor Teamsters have access to any of these funds at this time.
