Air Canada has filed for judicial review
This is an update to the ongoing base closure and capacity reduction dispute with Jazz Aviation LP, where Unifor has filed grievances. On June 25, Arbitrator Tom Hodges issued an Award rejecting the employer’s preliminary objection regarding the arbitrability of the grievances and referred a question to the Canadian Industrial Relations Board (CIRB).
On August 26, Air Canada – which was not a party of the award – filed a notice of appeal to the Supreme Court of Newfoundland and Labrador in response to Tom Hodges’ recent ruling regarding his decision and the referral to the board, specifically under section 35 (1) of the code for a single employer.
The following is a quote from the Award
“However, the broader and extensive issues relating to the bridging agreement, sole authority of Air Canada to affect Jazz base closure decisions, without consultation with Jazz or Unifor are significant. Considering and determining the related closeness, integration, or nature of the business relationship between Jazz, (the Employer) in this case, and Air Canada are fundamental matters in this dispute which are not matters before me. I find they are matters more properly before, and better dealt with by the Canada Industrial Relations Board.”
